1. Agreement to Terms

By accessing or using Thalora (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

Thalora is an AI-powered journaling and introspection application provided on a structured subscription basis or free trial. The Service allows users to visualize life events, track goals, and receive AI-generated analysis.

"Local-First" Nature: You acknowledge that the core data of the Service (Journal entries, Timelines) is stored locally in your browser's memory. Thalora does not keep a backup of your local journal data.

3. Medical and Advice Disclaimer (Crucial)

FOR INFORMATIONAL AND INTROSPECTIVE PURPOSES ONLY.

• Not Medical or Mental Health Advice: Thalora, including its AI features (e.g., "Life Coach"), is NOT a substitute for professional medical advice, diagnosis, treatment, or mental health counseling. Never disregard professional medical or mental health advice or delay in seeking it because of something you have read on the Service.
• Not Financial/Legal Advice: Any analysis of "Life Decisions" provided by the AI is a simulation based on your inputs and should not be treated as professional financial or legal counsel.
• AI Limitations: You acknowledge that AI responses can be inaccurate, misleading, or hallucinated. You are solely responsible for evaluating the accuracy of any output.

4. User Accounts and Subscriptions

• Registration: You must provide accurate and complete information when creating an account.
• Subscriptions: Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis (e.g., monthly).
• Free Trial: We may offer a Subscription with a free trial for a limited period. You may be required to enter your billing information to sign up for the Free Trial.
  • Abuse: You agree not to create multiple accounts to bypass Free Trial limitations. We retain your email/identity hash indefinitely in our trial_history to prevent this. We reserve the right to ban users who abuse this system.
• Cancellation: You may cancel your Subscription at any time. Cancellation is effective immediately, and your access to premium features may be revoked immediately.
• Refunds: Except when required by law, paid Subscription fees are non-refundable.
• Grace Period: If your payment method fails, we may provide a short grace period (approx. 14 days) during which we will attempt to retry payment. If payment fails after retries, your subscription will be terminated.

5. User Responsibilities & Data Security

• Backups: You are solely responsible for exporting and backing up your journal data regularly (using the "Export JSON" feature).
• Data Loss: The Developer is NOT liable for any loss of data resulting from:
  • Browser crashes or closures.
  • Clearing of browser cache/storage.
  • Device failure or theft.
  • User error.
• Local AI: If you choose to use the "Local AI" feature, you assume full responsibility for the installation, security, and operation of the local LLM software (e.g., Ollama, LM Studio) on your device.

6. Acceptable Use

You agree not to use the Service:

• In any way that violates any applicable national or international law or regulation.
• To transmit any material that is defamatory, obscene, legitimate, or offensive.
• To reverse engineer, decompile, or disassemble the Service (including the "Soul Map" prompts).
• To attempt to extract, copy, or reproduce any system prompts, AI personas (including "Soulful Introvert"), or internal instructions used by the Service.
• To attempt to bypass security measures, such as the AI token quota system.

7. Intellectual Property

• Your Content: You retain ownership of the journal entries and data you create within the Service.
• Our Content: The Service and its original content (excluding Content provided by users), features, and functionality (including the "Soulful Introvert" persona) are and will remain the exclusive property of Thalora and its licensors.

8. Limitation of Liability

In no event shall Thalora, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. Your email will be retained in our abuse-prevention records if you have utilized a Free Trial.

11. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
